1. Do my part-time drivers need to be in the drug testing pool?

Yes. Federal drug and alcohol testing is an employer, not employee requirement.  An employee, full or part-time, may be in 3 or 4 pools if he/she performs safety sensitive functions for    multiple employers.  49 CFR, part 40.1 states that this includes "all transportation employees including self-employed (owner operator), contractors and volunteers,(churches/Boy Scouts) as covered by DOT regulations."

2. Is a CDL drivers blood alcohol level (BAC) different from a non-CDL person?

A blood alcohol level of .02 is a violation while performing safety sensitive functions.  An employer is required to remove this employee from safety sensitive functions until their next regularly scheduled shift.  A blood alcohol level of .04 or higher is treated just like a failed drug screen.  Go to the section on Substance Abuse Professionals for guidance on failed drug and/or alcohol screens.  Note:  When off duty, your employee is treated like any other citizen and is subject to your states BAC.  (.08 in WI)

3. What do I do if an employee has a confirmed positive drug screen?

First, consult your drug and alcohol policy.  You have the option of termination or rehabilitation.  However, you must decide which option fits your company and treat all employees the same.  If you choose rehab, there are specific procedures to follow.  Go to the section on Substance Abuse Professionals for details.

4. Where do I find a Substance Abuse Professional?
